Purpose of the Role:
- As a Litigation Claims Executive, you will play a crucial role in managing and escalating international withholding tax claims requiring formal legal action.
- Your work will focus on proactively litigating delayed or unassessed claims with tax authorities and Courts, participating in regularisation projects, and assisting in proactively working on incomplete claims.
- This role demands legal drafting, case and deadline management skills, and the ability to collaborate effectively across internal teams and with external stakeholders.
KEY RESPONSIBILITIES
Litigation and Claims Case Management
- Manage litigation and appeal processes for withholding tax claims that remain unassessed or delayed, ensuring timely escalation.
- Lead regularisation projects to proactively litigate dormant claims and compel assessments by relevant tax offices or Courts.
- Maintain detailed and accurate litigation files, monitor deadlines, and ensure compliance with jurisdictional requirements.
Pre-Litigation Risk Identification
- Identify high-risk queries or claims with missing documentation that may lead to litigation.
- Work with internal teams to resolve issues or prepare cases for formal legal escalation.
Legal Drafting, Research & Tax Law Updates
- Prepare legal documents and correspondence, conduct research, and stay updated on tax laws, regulations, and court rulings to support and strengthen case strategies.
Tax Law and Judicial Developments
- Continuously monitor and stay informed of new withholding tax regulations, court rulings, and judicial precedents relevant to international tax claims.
- Analyse the impact of legislative and judicial changes on ongoing and future litigation cases.
- Proactively incorporate updated legal knowledge into case strategies and team knowledge sharing.
Collaboration with Internal and External Stakeholders
- Work closely with the Team Leader as well as Legal, Operations, and Client Service teams to align on litigation
- approaches and documentation needs.
- Liaise with foreign tax authorities, external agents/attorneys, and international offices during disputes.
Process Improvement and Compliance
- Identify opportunities to improve litigation workflows and reduce future claim disputes.
- Ensure all activities adhere to company policies, legal regulations, and confidentiality standards.
EDUCATION
- A bachelor’s degree in law (LLB, BA Law, BCom Law) is advantageous; however, candidates with a degree in a related field combined with relevant legal or tax, experience will also be considered. Prior completion of legal articles is not a requirement.
COMPETENCIES
- Proficient in Microsoft Office Suite (Word, Excel, Outlook).
- Legal drafting, research and case management skills.
- Excellent written and verbal communication skills, including client-facing interactions.
- Ability to manage multiple priorities and work independently in a hybrid work environment.
- High attention to detail, confidentiality, and professionalism.
- High organizational skills.
